One Nation One Food Law

To achieve consistency across states, by enforcing food safety regulations and standards, FSSAI launched its "One Nation One Food Law" program. The regulator has leveraged Infotech to implement identical standards for testing and sampling in various states and laboratories in India.

Regulate the manufacture, storage, packing, distribution, sale and import of food products.

Ensure the availability of contamination-free and wholesome food for human consumption.

Food License

The FSSAI or Food Safety and Standards Authority of India was incorporated under the Food Safety and Standards Act (FSSA) of 2006. It consolidated various laws and orders that were previously applicable and used to handle food related issues in different ministries and departments. The basic objective of formulating FSSAI has been to establish science-based standards for food and regulate its manufacture, storage, sale, distribution and import to ensure the availability of healthy and adulteration-free food for human consumption.

Process of Basic Registration

Every Organization shall register itself with the Registering Authority by submission of an application form, along with the fees as applicable.

A Unique Application Reference Number will generate.

Registering Authority may grant or reject the application â€“ with reasons being recorded in writing. Within 7 days of the receipt of the application.

On the grant, the organization may commence the business operations.

Or, if decided necessary, the Registering Authority may issue a report for inspection. This is ordered within 7-days. And the inspection is conducted within 30 days.

If through the inspection, the inspecting FSO or agency is satisfied, the FSSAI number will be granted.

Procedure for Food License (STATE OR CENTRAL)

Filing of Application Form no. B. All associated documents attached and fees paid, as applicable.

Unique Application Reference Number is generated on this.

Now, there are 3 ways possible:

If FSSAI complies with the details provided in the application and the documents submitted, the organization can begin its business operations.
Or additional documents may need to be submitted or some other information missing from the application may be required. Upon submission, a unique app ID is generated on this. Now, if no inspection is required, the FBO can start operating after 60 days. However, if an inspection is required, a report would be performed and issued. Now, the license will be granted if all formalities have been completed, within 60 days. If in the case, the inspection report is not processed, the organization can start the business after 60 days.
Or the organization receives a Notice of Improvement. It will also mention a period within which the case will be modified. If the problem is not resolved within that time period, the request will remain on hold. And another date will be announced along with a fine payable. If the problem is still not reviewed, the application will be canceled. A new application can be submitted only after 90 days of this cancellation

Supporting Documents

The documents that are necessary to be submitted by all FBOs, have been mentioned below. Whichever type of Certificate you are applying for. Basic Registration, State or Central License.

Form A or Form B (Form â€“ A for Basic FSSAI Registration & Form â€“ B for State and Central FSSAI Registration) â€“ completed and signed.

2 Passport Sized Latest Photographs.

PAN Card of the Business Owner/Proprietor/Partner/Director.

Proof of Possession of the Premises (Property Papers â€“ for owned property. Utility bills (Electricity or water) or Rent Agreement â€“ if the premises is on rent).

Partnership Deed.

Certificate of Incorporation or Articles of Association (AOA) of a company.

The complete list of food items that the unit will be processing.

The planned FSMS (Food Safety Management System). Applicable for FSSAI State or Central Food License only.

Authority letter with name and address of responsible person nominated by the manufacturer and an alternative responsible person indicating the powers vested with them. Such as, assisting the officers in inspections, collection of samples, packing & dispatch. This is mandatory for manufacturers and processors, (applicable for Licenses only).

Analysis report (Chemical & Bacteriological) of water to be used as an ingredient in food from a recognized/public health laboratory to confirm the portability. Mandatory for manufacturing and processing units. (applicable for Licenses only).
